Delhi HC: DoE’s Nursery Admission Criteria Arbitrary And Against Public Interest

If you are a parent who is in the throes of getting your child into nursery this admission season in Delhi, here is news for you. The Delhi High court today said that the distance/neighbourhood criteria as proposed by the Department of Education is arbitrary and against public interest and ordered a stay on the application of the criterion. As the chaos on the Delhi Nursery admissions continues, here is an update from the Delhi HC. The DoE had earlier announced guidelines for admission based on distance as the primary criteria.

The Verdict:

Delhi HC:  Neighbourhood/distance criterion is arbitrary, discriminatory & against public interest.

Justice Manmohan also remarked, ” State cannot impose a restriction on the choice of parents to choose a school for their wards just because it is beneficial for their child.”

The court has cited the lack of good schools in the city as the major cause of the confusion.

What it means for parents:

  • The court has issued a stay on the guidelines for nursery admissions in the national capital for the 2017-18 academic session. So schools, we believe, now have a free hand in choosing the admissions criteria.
  • The status of applicants who went by the neighbourhood criterion now hangs in the air- and for us as parents, the wait continues.
